Just so that we are clear here.

The rules of CS, as far as I know, are caveat emptor.

Nobody here, from the MOds on down, is going to force you to refund his money, or make good on this.

On the other hand, how you deal with it WILL be viewed with interest.

I don't think it is a fair assumption to say that no one wants to back you.

You asked for opinoins and you're getting a few.

I personally said I wasn't going to get involved, but I am now.

Facts:
Buyer paid
You Shipped with DC#
USPS said delivered.
Buyer said not recieved.

Next logical step:
Confirm with USPS that the package was delivered to correct address. That is on you to initiate this step. If the USPS says "Yes, we delivered it where you wanted it" then you should tell the buyer that fact.

A whole new dialog should start from there.
Maybe then the buyer could speak with his/her postal delivery person and try to ask if indeed there was a delivery.


I could ramble all day, but this needs to be approached with some level of reason.

I think it would because it is not unusual for the postman to drop a package at the wrong address. I know in the past with C-Bid purchases I have had my old neighbor knock on my door to give me a package that was delivered to his door. Another perfect example is last Saturday I happened to be at the mailbox and my Postman asked me if the persons who's name was on an envelope lived in my house. I looked at the envelope and it had my neighbors name and my neighbors address. I pointed this out to him and I think he felt pretty stupid but just goes to show that honest mistakes happen, so there it is a good chance it was delivered but not to the intended address. The PO is aware of the fact that this happens and they would probably investigate it and find that the package went MIA and would make good on the insurance. On the other hand I would call the Post Master like previously mentioned and if that person has a regular for that route he may remember delivering the package and where it was delivered.
I don't think anyone is accusing you of not shipping the package. They are just giving you honest answers which you seem to not agree with, which looking at your join date it seems you are pretty new here so you may not fully understand the way pf the jungle. Most BOTLs and SOTLs who frequent and participate here normally go above and beyond the call of duty and just don't follow protocol so your answer to this just seems foreign to many of us here. Most people here IMHO would chalk it up as a learning experience and make good on the deal one way or the other even if it were lost. Again, just my opinion and

Think of it from the buyers side.

I agree with your comment, why should you be out the smokes. But I raise you the question, why should the buyer be out the money? This is a crappy situation all around, but there are two sides here that could possibly get screwed.

Please talk to USPS (probably won't get you anywhere but try it), then you need to figure out something with the buyer.

From all the dialogs I've heard about USPS, there is no reason to insure Tobacco because you cannot make an insurance claim on perishable items.

I HATE the post office. What a waste of breathable air. I make sure all my incoming packages "Require Signature" Yet they just leave stuff on my front porch. These guys are scumbags. Quality of service is going down faster than they can increase the postal rates?! I have had packages dripping and delapadated and they are standing in front of me saying they arent responsible because I cant prove they did that...WTF?!?! it is in their hand. WTF, should I have to pay for insurance...I am already paying you too much...I pay you to deliver the package...if you fail...you fail and are responsible. If I take my car into the dealership to get new tires put on and they smash they are liable for the damages.

Sorry for the rant and even more sorry if you are a postal worker but...

Perhaps you could give the buyer half the money back... you got screwed out of smokes, he got screwed out of money. There is gray area though and this:

Ive dealt with Bruin7 before and he is pretty quick with shipment and response and I wouldnt hesitate to do business with him again. Its the holiday season and just think about all of the other packages being shipped. There is a chance that USPS is behind and to be honest I think that their system has an automatic update. Like I said before I would give it a day or so and then call the post office directly. Hope things get resolved so both sides are happy

Also, he stated that this has been nearly 2 weeks and the automated system showed it delivered after a few days.

True. My statement is purely speculation but on the flip side I have recevied packages numerous times and not had the system show delivered for over a week. Im in somewhat of a similar situation because someone sent me a package that shows delivered and I have not gotten anything

When I have been in situations like this one, I bucked up and sent another package. It is up to the parties involved to agree on what they think is fair.

I had an issue with payment getting lost in the mail, but that was the 1st incident I have ever had, and from now on everything gets with a DC and insurance no matter what it is. As far as the OP....The question was raised about the buyer being an established member. I don't think anyone is saying that if you're not an established member, you may receive and deny you ever did, but as an established trader with a spotless track record it would seem strange to cut and run over a $50 transaction. As far as advice and opinion...It's been said. Try and find out what happened through the post office, and come to a solution with the buyer you both can agree upon.

Have the person call their post office to see if the package is there to pick up. The P.O requires the clerks to scan all the priority mail packages with delivery confirmation upon arrival to the delivery office. If the clerk hits "delivered" instead of "arrived" on the scanner this would cause the problem you are having. 9 times out of 10 the package was attempted at the delivery address but was not left due to weather conditions, no safe location to leave,...etc. and the Letter carrier brings the package back to the office.
