true enough. i haven't met a bad one and a lot in the local area are my clients. the postal system might not work as well as we want it to but no "courier" organization is perfect.

i'm in the same situation but there was no money involved. shipped a package and it says delivered but not there and believe me if the recipient had gotten it they would have told me. i asked and no dice yet but who knows. honestly giving it 30 days and calling the post master is your best advice given here. if not it's 50$. not really too big in the grand scheme of things. many have given up more than that in bombs and been happy to do so

(It won't, by the way.) It's up to the buyer and seller to make this right. There are four possibilites here:
*The item was delivered and stolen.
*The item was misdelivered and is at another adress
*The item was delivered as stated
*The item was never delivered, but scanned as if delivered

The delivery confirmation is evidence that an item was shipped and delivered, and I would think that alone would relieve the seller of any further responsibility, if this issue made it to arbitration. That's a harsh stand. Personally, I'd give back the money right away if I were the seller or persue the matter further with USPS if I were the buyer.

I completely agree...I have had trouble here and there with th Post Office but to say they are a waste of breathable air and scumbugs is really crossing the line. These are some hard working people...especially this time of year.

I agree with the earlier post that said the best way to handle this was to refund half the money if the package cannot be found. It is neither party's fault but there has to be a compromise....

This is wrong information, I'm sorry.

Up to now we've been talking about what a person should morally do.

Legally speaking, the above information is incorrect, and in case someone has a similar problem in the future I'd hate to see them operating under a false impression.

What we are talking about here is a contract between the buyer and seller. The buyer agreed to pay 50 dollars, and lived up to his end of the bargain.

The seller had an obligation to deliver the cigars. He didn't do that, unless he can prove that they were received, not delivered.Maybe the seller has an issue with USPS, maybe not because he didn't buy insurance. But it is not up to the buyer to take it up with USPS, it's up to the seller as a legal matter.

I did a trade awhile back and had the same problem, I am pretty sure he is still a member here, not sure exactly who it was, but it said delivered and I sent him a pm asking about it and he told me he would check on it. Turns out that the post office delivered to the wrong house. Both of us were newer members at the time with little positive feedback. Have trust in the guy you sent the package to, packages get lost or delivered incorrectly. It is a very busy time for post office employees, I just had a priority package mailed within my state that took four days to get there.
Edit-Think of the buyer in this situation, if I bought the package from you and you didn't believe me when I said it wasn't delivered and you started a thread like this, I would be pretty ticked off.

Kind of a sticky situation, all legal things aside I would try to work it out with the person you traded with, which is what Allen is doing I believe. May not have the exact sticks, but Im sure something can be worked out for the both of you to be happy. Its neither persons fault if the package got lost, it happens. Ive had it happen to me a couple of times too. Ive traded with Allen and he is a stand up BOTL, sorry this happened to ya bro.

Side rant My regular postal guy goes the extra mile to make sure my packages stay out of the rain and get delivered to me....now his relief person could use some schooling

ok you guys are right. I crossed the line with the insults. But my rant of the postal system stays. If you had great dealings good for you, but I can count on 1 hand the number of packages that were delivered properly with required signatures. I have even fought missing packages that the USPS has come back with a signed slip (forged) that had perfect cursive of my name. My signature is illegible and more of a consistent scribble.

I would guess that over 99% of the packages sent USPS from members on the board here are delivered without a problem. Its easy to point fingers at mail carriers and rant about their service but your(foxtrot7) posts contribute absolutely nothing to this thread.
Its time for the buyer to do a little legwork. Check with his mail carrier, if it is a regular carrier he may remember the package. Check with neighbors, who may have received the package and sent it back to the PO. Check with the local PO who may be holding the package.
Insurance does very little in most cases. To even start an insurance claim, I believe you have to wait 6-8 weeks before you can make the initial claim.
Two weeks is time to start doing research and legwork, but not yet time to panic. As long as the receiver is an established member I think you should both be taken at your word. Hope this all works out, for both of you.

Sounds like this is settled. I had a similar problem about 2 months ago with a buyer. DC said delivered and he said he never got them. I sent replacements and the original package arrived a week later. Then, I went from being the guy who tried to cheat him to the guy who never got either package back.

Sucks, but shit happens. I know I'm a good guy for taking care of things. He knows he's a POS because he stole $75 worth of smokes.
