We don't allow the ATF, or any other federal agencies to meddle in our affairs in Utah; we are an independent state and have the mormon church to guide/watch/follow/judge us.

unfortunately, I was at work while all this roid rage was going on, but the only thing you could get in trouble for would be for buying underage, or buying online cubans, which are most likely fake anyway. As far as the tax thing is concerned, as long as you are honest about what state you are from, it's the responsibility of the cigar seller to charge you the correct tax, am I right Stan?

Like C-man, I think there is just not enough info to go on here. What did this list contain? And why in the world would ATF care about cigar purchases if the above criteria were maintained?

Go ahead and buy LEGAL cigars without worry. It may be that your B/M dealer was selling Cubans and the G-man had a list of the buyers. Keep it all above board and you have nothing to worry about. BUY, BUY, BUY!!!

And welcome to the board. CycleMan is an awesome dude, and this is a very touchy subject for us tobacco lovers. Glad you made up and kissed.

Actually, it is up to the consumer to report their own online and mail order tobacco purchases to their respective state. It is not the responsibility of the vendor to do it. It is only the vendors responsibility to collect the taxes of purchases made by customers who live in the same state where the vendor is located.

Correct, Monty! The states wanted the out-of-state on-line vendors to collect the sales tax for them, and the on-line vendors said, "BITE ME!" . When the states realized they had no legal recourse, they put the onus on you and me to report to our individual states our out-of-state purchases. This is for everything. Computers, furniture, anything that you don't pay state sales tax on.

Ok, I'm confused now. You mean that we, the consumers, are responsible to pay taxes on merchandise to our state AFTER we've made our online purchase? This is a new one on me. I always thought that the vendors collected the sales tax. How are we supposed to do that?

Ohio's sales tax laws states that sales tax is charged according to where it was shipped from.. not where it is shipped to.. This just recently changed.. so how is OH supposed to collect out of state tax?

See, that's it. The states, via lawsuits, have realised they have NO jusrisdiction to require out-of-state vendors to collect taxes for them. So, they put the onus on their citizens to "come clean" and voluntarily pay the tax.
Florida has a form for citizens to file quarterly. Want one?
Florida has NOT figured out how to track mail, UPS, FedX, etc. shipments. They DO have, however, Revenue Agents at our Georgia border(s) that look at bills of lading off of common-carrier trucks going to Florida to individuals that are having furniture, etc. "delivered" from North Carolina, etc. After a reasonable amount of time, they'll send the individual a copy of the bill of lading with the sales tax form, with the appropriate interest and penalties..........

The State of Florida knows it has no jurisdiction to make out of state vendors collect sales tax for them, so they "count on" the good citizens of Florida filling out a special form and paying it voluntarily.
Does that make sense?
