Neighbor Says Colorado Man Can't Smoke on His Own Deck - What the Heck!?!

I came across an article on the Colorado Springs Gazette Website where a woman is suing a guy because she doesn't like him smoking on his deck outside, nor inside his home. This is "anti-smoking Nazi-ism" gone overboard.

Here's the article.

First of all, the guy is smoking outside on his deck. Secondly, I highly doubt that the smoke can seep through the walls into her unit. If, by some slim chance that it actually does, then someone built a crappy building that needs to be fixed, and it is not the tenant's responsibility.

I think this woman is just a big drama queen desperate for attention, and she is most happy when she has something to complain about.

What do you think?

Well, having a lot of experience with deed restrictions, covenants and HOA boards, she does have a case. Its going to be a pure judgment call by the HOA board.

However, this line about summed it up for me....

"Actually, there may be a compromise possible. Acee said she likes an HOA suggestion that Libbey smoke out front, instead of on the back deck near her air conditioner and bedroom windows. But the idea hasn't been discussed because she objects to the way the HOA is treating her."

I am in a Condo and we have similar rules, so far though no one has complained about me smoking outside, but my neighbor (who I hate) does go inside when I smoke!


But this whole thing is terrible, I feel sorry for him, hope he wins!

Boo hoo, cry me a freeaking oxygen breathing river. Wait, isn't the air in Denver thinner since it's a mile above sea level, thus making it harder to breathe by default? So shouldn't she move to somewhere closer to sea level where there's more air to be had.... somewhere like San Francisco?

I live in a townhouse unit with 5 neighbors: two smoke (cigarettes) and three don't. Interestingly enough, one that smokes and one that doesn't smoke both hate my cigars... but one lady who doesn't smoke actually said that she likes the smell!!

The Gazette is the local paper for Co. Springs and I can say that some people here are too uppity and think their feces is odorless.

I think he should have a right to smoke outside no matter what. She needs to kick rocks and get out the house.

Here is the reality....ASH the anti smoking group will not stop until it bans smoking everywhere inclulding INSIDE your HOME!. In Hawaii they are pushing for HOAs to ban smoking in condos. They already have some apartments cowed. They tried it in Minneapolis at a condo bldg...at least they grandfathered current smokers. It is in court now.

You cannot be complacent. Oh by the way, in India ( I think I saw the article on google news) once they ban smoking they are going for booze next.

Used to have a neighbor here that complained about my cigar smoke. Nothing direct of course, she'd just go up the stairs out back of my back porch and mutter under her mouth and stuff as she went up. Sometimes I'd hear a "Ugh, that STINKS" as she closed her door. Oddly enough, after a few times of me and a few buddies sitting out there and REALLY smoking up the back porch, she learned to keep her f'in mouth shut She finally moved out...bummer too, cuz I think Zito sorta had a thing for her when I held that Herf here this summer
