Might be a good idea to at least give them a call to find out what they have and what their intentions are. What ever you do, DO NOT admit to anything or suggest they may be correct on any point. In fact deny any knowledge of having done anything wrong. Be very careful not to get trapped by somehting you might say. Once you have the information you can address it from there or pass the informatin to counsel.

Do you still have the invoice showing (only) a humidor, and, if not, can you get the vendor to FAX you one? I wouldn't call unless I had that piece of paper (and the total on it matched the charge showing on your credit card bill - or more correctly, their copy of your credit card charge.)

Then again, I know absolutely nothing about the American Justice System.

if you don't mind the vice prying...did they mention any sort of repercussions, or are they just letting you know that they know about business that took place in 2005?

on that matter, has anyone else gotten this notification, or similar for that matter? with all the isoms that run around on this board i find it ironic people are capping down for 2005.

I agree, have as much info as you can in hand. But I would approach it from a position of ignorance - i.e. "I received this letter, and I don't understand what you're talking about, could you explain it to me?" And let them tell you what they have. And deny knowledge of anything improper. If they ask if made a purchase you can tell them it was a humi, and that is all - nothing more! Then you at least know what you need to do to defend yourself.

still...this happened in what 2005? i think the fact that they are years late constitutes the shear stupidity of the claim.

That's exactly their intent! No, not a lawyer, I work for a living!!! I've just been around a while and don't take being shoved around too well. You know me, don't I look like a guy that's been around the block a few times too many!! (ha!!) Like they say, it ain't the age, it's the mileage!!!

Yeah...you should write them back and ask that future letters be printing on toilet paper so it wont hurt when you wipe your ass with them.

I think there are two apporaches you could take. 1. Do nothing. If they have not suggested an action being taken, or requested a response from you, sit tight and see what happens next. Problem is you're on defense if they come back again. 2. Take a more proactive approach and contact them first. Again, take the position you don't understand the letter and why it was sent to you in the first place. You can deny doing anything wrong, and they record that information - may be enough to kill it. You also get some insight for running some offense down the road.

I guess I'm still suspect as to why they would send a dunn letter if they intended no action. It would appear they put you on notice for some reason. Hard to really say for sure as I have not seen the letter either.

I think I remember reading a long thread about this very thing on CP. I forget why some received warning letters and others the "bad" letter.
