It's not public domain. They do own the trademark for the fleur de lis, they trademarked it this year, and this case is a trademark infringement case, as the docket clearly shows:

Just as the NFL has the fleur de lis trademarked for the New Orleans Saints, there are at least 35 trademarks for the fleur de lis just in relation to cigars:
