No Smoking Ord.

Anyone in these parts versed in "legaleze", as such? We just got the write up for an ordinance for a no smoking law that is going up for a vote this month here in Grand Forks, North Dakota. But to me, this Ord. seems to switch back and forth, and honestly doesnt make much sense. I just wanna know from someone who is pretty well versed if its as staunch as it sounds. Thanks guys,

I'm from the republic of Minnesota next door where everything is illegal..The anti smoking Nazis are trying to get the whole state smoke free this session. I read over the ordinance and it is the typical BS.
These people are so worried about employees, sure they are,,they are just using that ploy to get their agenda across..Once that is passed they will start heading for alcohol..It will go on an on..

This is total BS! The smoke nazis are pushing very hard now aren't they? Once ordinances like this are passed it is nearly impossible to get them repealed. People need to wake up here and realize how quickly their liberties are being eroded.

The first "finding"

"Tobacco smoke is a leading cause of disease in nonsmokers" which is simply rediculous.


then...a little farther down "Objective evidence does not bear out the fear that elimination of public smoking will harm a
community’s economy or result in a net loss of jobs in restaurants and bars."

On the contrary, David Weldon writes for the Primedia Business Magazines and Media Inc in 2003:

"City officials in Rochester, Minn., this year lost what would have been the first national meeting of the American Veterans Association in their city. The event had been booked five years earlier, according to Brenda Riggott, executive director of the Rochester Area Convention & Visitors Bureau. But once Am Vet officials learned of the city's new anti-smoking ordinance, which bans smoking in public restaurants and bars, they quickly looked elsewhere - rebooking in Kansas City.

"The meeting would have had around 1,200 attendees. That's a good size group for our city," Riggott says. "Attendees can stay up to a week, and it would have represented 5,000 room nights for us." "

and also, "Hacker says that Dallas also lost two events this year due to a recently passed smoking ordinance. But in each case, he says the city failed to try to work out an arrangement that would have kept the groups. His advice:

Public policy makers need to fully understand the impact that these events can have on the local economy, and should consider the full impact on convention and hospitality business before adopting sweeping new ordinances."

Next in 2004 Camille Wheeler writes for The Austin American Statesman: ""The chamber is finally doing what it's supposed to do: look after the interests of local businesses," said Amer Hammoud, president of Bennigan's and Denny's restaurants on Interstate 35 in Round Rock.

On Tuesday, a group of restaurateurs gave City Manager Jim Nuse a report they prepared that shows an average revenue drop of 15 percent for 15 restaurants since the ban started. The council reviewed the report at its retreat.""



Other than that the ordinance seems pretty straight-forward in preventing smoking everywhere except areas 25 feet away from any opening to a building (it prevents smoking in any place people work....cigar shops???) but also prevents smoking in outdoor bars or restaurants specifically.

It also says that the owner of a residence, vehicle or outdoor space can limit smoking on their property.
