Dad has 'no authority' after grounding ruling: lawyer Updated Fri. Jun. 20 2008 8:37 AM ET CTV.ca News Staff The lawyer for a Quebec man whose daughter took him to court to challenge her father's grounding punishment says that he will appeal a ruling that he had no right to ban his child from a school trip. Kim Beaudoin, lawyer for the man, told CTV's Canada AM that the father wants to reclaim the parental authority he lost when his daughter took him to court. "You can imagine that he has no authority towards this child anymore," Beaudoin said. "If she comes back home, the reaction will be every time he gives a punishment, well, you know, I can always bring you to court. That's not the situation you want in your family." Beaudoin said that the father also wants to spare other parents from having to go through a similar situation. The man had told his 12-year-old daughter that she could not go on a three-day trip with her classmates after she got into an argument with her stepmother. The father had also banned the girl from using the Internet after he found out she posted pictures of herself on a dating website. The father has custody of the girl, but she went to live with her mother after the family fight. The girl took her case to Quebec Superior Court, where Justice Suzanne Tessier ruled that the man had no right to ban his daughter from the trip. After the court ruling, the girl did go on the trip, a short class jaunt through Quebec to celebrate graduation from the sixth grade. The judge said that the father's punishment could not stand because the girl is now living with her mother. Tessier also said that banning the girl from the trip was excessive punishment. However, Beaudoin said that the father had told the girl at the beginning of the school year that she could go on the trip if her behaviour was good throughout the year. The man was "stunned" when his daughter brought the case to court. "He was so firm on the fact that he had given a punishment and he wanted that punishment to be maintained," Beaudoin said. "He never thought that she'd bring this to court."

![]() What is truly sad is that happens all over. I deal with many, many court cases as I am sure some of the BOTLs on this board that are attorneys do (I am not an attorney but in my line of business, I deal with the full course of litigation, up to trial, appeals, etc.). I can't help but remember some of the lunacy that has been decided by some of our illustrious judges in the US. You wonder how much crack they smoked before they heard the case. |

Let's blame the kids.........yeah.
The question should be "What's wrong with parents today?" and yes I am one. Kids behave the way they were raised. there are two major factors in a yut's upbringing. His/her partents and then their teachers. It is my belief that if the parents were held responsible for everything the child does (specially in the teenage years) the parent would definately take a bigger part in the parenting role. I believe that alot (and I am definately not saying all) of parents are lazy. they do not raise their children with manners nor do they raise them to respect. It used to be that if you got in trouble in school your mom would go to the school and both your parents and teachers would yell at you. NOW days the parents go to the school and yell at the teachers for little Johnny getting in trouble. Now that is BS. I have digressed. But I am very passionate about this topic. AND believe me I have not done a very good job of parenting. I have a 17 & a 21 y/o......... THE END |

The father had also banned the girl from using the Internet after he found out she posted pictures of herself on a dating website. Sixth grade... That's like 11 years old. Did she seriously lie and say she was 18? There's a big difference between 11 and 18.
... Justice Suzanne Tessier ruled that the man had no right to ban his daughter from the trip. How does Judge Suzanne Tessier have any right to rule than a man has no right to punish his children? Not knowing anything about Canadian Law, but taking an educated guess, I would tend to think that the parent with primary custody has the right to issue punishment to a child. The Judge ruled this way because the girl was no longer living with the dad. This is an issue of the parents not backing each other's decisions, and undercutting each other's authority. The blame for this lies squarely with the parents. ... the girl did go on the trip, a short class jaunt through Quebec to celebrate graduation from the sixth grade. This is a little ridiculous in and of itself. HEAR HEAR! ... Tessier also said that banning the girl from the trip was excessive punishment. Excessive punishment? Really? Canadians regulate excessive punishment in the home? I feel that the judge has every right to rule on the excessiveness of punishment, otherwise where would child abusers be brought to justice. The American legal system regulates this, and there is such a thing as excessive punishment in the home. HOWEVER, this Judge just seems to be off her rocker in determining that this was excessive. Again, I know nothing of Canadian Law. ... Beaudoin said that the father had told the girl at the beginning of the school year that she could go on the trip if her behaviour was good throughout the year. Expectations set+expectations broken=promised punishment

My coworker just got mad at the teachers b/c her daughter got a C in a class. She told me that she told her teacher to tell her if she was not doing well. Mind you nothing about asking her daughter how she was doing in class. I don't think I ever got a grade that "suprised" me. I also have noticed that kids (at least around here) are not hard on other kids anymore. If I walked around in the Emo stuff that I see kids wearing, I would have gotten a beating. I see kids acting up and other kids tell me, well he/she has ADHD they have always been like that. If I acted that way when I was in my teens I would have got punched in the brain by another kid.
