Way I heard, the guy actually fanned the fart toward the Officer, thereby eliciting the battery charge.

Still think the cop would have done better to tune the asshole up.

Charleston is only about 45 minutes from me. Sadly, this is true, but here's an update:

UPDATE: Thursday @ 11:04am
Kanawha County Magistrate Court reports that the "battery on an officer" charge against Jose Cruz has been dropped.

Magistrate Jack Pauley says an assistant prosecutor came to the office and requested that charge be dropped.

The DUI charge and and obstruction charges against Cruz still stand
