We must interpret everything. That does not mean there are multiple meanings, but rather multiple interpretations. Either the 2A applies only to the militia or it applies to everyone or neither. A cannot be non-A, A is A, and A or non-A.

No offense taken. Everyone has the right to be wrong sometimes...it's just your turn I'm sorry, I couldn't resist.

What does "shall not be infringed" mean to you?

I may need a small handgun to defend my home, a larger handgun to defend my town, a shotgun to defend my county, a rifle to defend my state, or a number of guns to defend my country. Why shouldn't I be able to get them all at the firesale if I choose to do so?

We likely will all agree that no "right" is absolute. Those who have been convicted of felony crimes should rightfully be denied. Those who have been adjudicated mentally incompetent, insane, or unstable should rightfully be denied. But, average, everyday, law abiding citizens? Why?

The government has forced its way into our cars to make us wear seatbelts. May we not stand for intrusions into the homes of the lawful.

Maybe things are different in your neck of the woods....but here in mine when You made an arrest You had to call to see if there was any room at the Inn. The county Jails have prisoner capacity ratings. If they are rated for 105 and they had 105 ,theres NO room.

ROOM for an inmate IS a problem out here. And our facilities are NOT run by private enterprise, but by the City, County or State. We do have a single prison that IS private but it only holds Fed prisoners. Doesn't really impact local LE.

Your mention of two Attorneys in your Family speaks volumes regarding your outlook. LOL!!! Couldn't resist!!

thisone326, I noticed you are studying history. Be sure not to only read one side on this issue.
  • That Every Man Be Armed, by Steven P. Halbrook (traces the philosophical, historical, and legal roots of the right of the citizen to have arms, beginning in ancient Greece and carrying the analysis forward to legal and policy controversies of today.)
  • Supreme Court Gun Cases, by David B. Kopel, Stephen P. Halbrook and Alan Korwin (Reprints of everything the U.S. Supreme Court has every written on the right to arms, gun control and the right of self-defense, with
  • Origins and Development of the Second Amendment, by David T. Hardy–Presents the 75 most important documents about the Right to Keep and Bear Arms.)
  • Gun Control and the Constitution, by Robert Cottrol (The most important state and federal cases and law review articles dealing with gun control.)
  • The Origin of the Second Amendment, edited by David E. Young (Reprints every single original documentary source about the origin of the Second Amendment from 1787 until the early 1790s.)
  • To Keep and Bear Arms, by Joyce Lee Malcolm (Tells the story of the English right to arms in the 17th century England, and how it was central to the century-long struggle between the despotic Stuart Kings and advocates of republicanism and limited government.)

I have not read all of these titles.

"i have no problem with rifles, shotguns...my quarrel is with hand guns, which have little use in a militia"

A similar arguement was made in the 1933 Miller case (I hope that's the right year and name.) The short barrelled shotgun was not in use in the military, hence, it was not allowed. The rifle and handgun have both been in use in the military for over 150 years. I think that makes it appropriate for the "militia", which, by the way, is not those who had rifles, as you stated, but "each and every free able-bodied white male citizen of the respective States, resident therein, who is or shall be of age of eighteen years, and under the age of forty-five years (except as is herein after excepted) shall severally and respectively be enrolled in the militia, ... every citizen, so enrolled and notified, shall, within six months thereafter, provide himself with a good musket or firelock.... " (Militia Act of 1792). We have since changed ages for drinking, military service, voting, etc. as well as expanded rights to women and blacks. By comarison, I think that makes the militia now pretty much every adult not "excepted".

Isn't this the exact type of political conversation that needs to be avoided on a cigar site with a no politics rule.

Is that really any different than postings about a smoking ban or restriction? Not trying to be a smart ass, but it looks like pretty much the same thing to me.

Well from my experience most smokers agree about smoking bans.
As far as other politics go it's wide open. I know I've been pissed off to the point of not wanting to post here anymore because of political arguments like this one.
