The Ambien made me do it! - Kennedy

Ambien is the new devil for all drunks who need an alibi. This guy who told his patrolman to take Kennedy home needs to be fired from the force. I know if I ever find myself in an "ambien situation" I'll remind the cop about the Kennedy Code of Law. F these people and their afforded rock star status.

I know what you mean. Drives me nuts. But caught some of the details on the news today. Once he said he was on his way to vote the police have to play by some very ridged rules. If he is on official business then he is immune from just about everything but felonies. Yeah lied his ass off about voting, but once he made that comment the police have their hands tied on what they can and can not do at that time. That is why there was alcohol tests done. Sounds like a bunch of crap to me, but well could be how it works. Good old double standard. Those that write the law do not have to follow the law.

Will be interesting as more and more of the details filter down on this and see if the above is all true or just the news guys running the mouth or the officers involved covering their self. Sounds like a couple of higher up Officers showed up real fast and relieved the first officer on the scene. Going to get interesting.

In any case, any evidence they might have had gotten is long gone.

Having not read all of the news about the latest Kennedy folly, I take it he is blaming this on Ambien. Ambien is some pretty potent stuff in my (limited) experience. When I have taken it, it has knocked me out for about seven solid hours and does it in a pretty big hurry, to boot. And by out, I do mean OUT. As in, not getting up and going anywhere under my own power kind of out. I do understand it can be habit forming, but a fool is a fool. He is responsible for his drug habit, and he is responsible for drinking (even "a little", per a news report) while feeding his habit. That he should get a pass out of this (and he will) just points out that a double standard exists which really should be obliterated. Like father, like son.

There just seems to be something about a Kennedy and a car. Add water/ booze/mistress and you've got a real party on your hands. Those folks get away with more crap.

Not so fast. I'm not familiar with the statute in D.C., but here in NY you have both D.W.I. (driving while intoxicated), but also DWAI (driving while ability impaired). The law as written in NY doesn't give a rats a** what you are impaired by. could be Motrin, aspirin, or your girlfriends Midol Depending on how the statutes are written in D.C. and how they have been interpreted by the courts down there, just claiming that "the ambien made me do it" is NOT going to save his butt. Will be interesting to learn some more of the facts.

We have somethng similar here in Texas. DWI and DUI. Driving under the influence. And it can be anything.

So far there have been NO charges filed against him. This whole situation reeks.

I absolutely agree the situation reeks. I don't see how they won't charge him though. I don't think they have a choice, they'll have to. The guy pretty much admitted he was DWAI, saying he was "disoriented", etc. I haven't seen any of the footage or heard his exact quotes yet so it's hard to say for sure, but If he had been smart he would have kept his mouth shut until he spoke with his attorney (of course that would be my position )

Not that you are stupid by any means ResIpsa. Just that i totally agree!

He does have the right to remain silent. My view is let your Attorney do the talking, atleast have him/her present.

I went and had my license renewed today. Because I am a diabetic on insulin and other meds, I have to go to the doctor to get him to fill out forms saying I am able to drive. I have to go see an eye doctor, even tho I passed the eye test with no errors. And I have to take the Driven test every time I renew my license. Which I found out I must now take every year.(possibly every six months) But politicions and stars get off scott free that sucks!

Heres's a question for you lawyer folks. Can you be charged with a DUI/DWI/DUAI if you are a diabetic and your glucose level drops while driving.(because this effect is a lot like being drunk) Either causing you to be pulled over,have an accident or such.

No, because you are not being influenced by any foreign substance. Any accident that is caused by your glucose level dropping would be akin to falling asleep at the wheel (you could still be charged, but not with DWI/DUI).

The short answer: you would have to ask a Cali lawyer. The long answer from someone not admitted in Cali? Depends on what the statute says. Whether or not its a "foreign substance" that is impairing your ability to drive is immaterial, UNLESS Cali law says that it must be a foreign substance that is impairing you. Frankly I would be surprised if the law DID say it had to be a "foreign substance", because you then get into the problems of defining what a foreign substance is etc. Example: the treatment of a number of disabilites, diabetes included, involves introducing a substance into the body that is SUPPOSED to be produced naturally by the body, but in this particular person is not. When I take my medication am I introducing "a foreign substance" because the substance is in fact foreign to my particular body? In law, the devil really is in the details.

Not to freak you out, but In the scenario you describe with your glucose dropping I would be more concerned with someone suing you for negligence.

Resipsa, great answer, and I'm not a lawyer (I majored in law though as an undergrad), so I will agree with you, but for argument's sake- his situation is that he is not putting anything into his body. Therefore, he couldn't be charged with DWI/DUI because he isn't under the influence of anything (what I meant by foreign substance). Logically (my logic!), it would be akin to falling asleep which would definetly open him up to some kind of negligent criminal/civil action, but he would not be under the influence of anything (which is the problem, he needs insulin). I'm not arguing with you, but I'm curious, law has always fascinated me and I've often thought about going back to school when I get out of the Army.
