SAN FRANCISCO Judge invalidates Prop. H handgun ban Ruling says measure intrudes on an area regulated by state Bob Egelko, Charlie Goodyear, Chronicle Staff Writers Tuesday, June 13, 2006 A judge struck down San Francisco's voter-approved ban on handgun possession Monday, saying local governments have no such authority under California law. Proposition H, which passed with a 58 percent majority in November, would have outlawed possession of handguns by all city residents except law enforcement officers and others who need guns for professional purposes. It also would have forbidden the manufacture, sale and distribution of guns and ammunition in San Francisco. San Francisco Superior Court Judge James Warren agreed with the National Rifle Association, which argued that Prop. H exceeded the powers of local government and intruded into an area regulated entirely by the state. The NRA sued on behalf of gun owners, advocates and dealers the day after the measure passed. Enforcement of the measure was suspended while the suit was pending. Thank Pete for this decision. Yes, the idiot politicians in SF will appeal this ruling, but this is a great strike against the stupervisors in this once great town. Lesson: DO NOT TRY TO DENY OUR CONSTITUTIONAL RIGHTS.

I think this is good news for ALL gun owners everywhere. Yeah, the liberal antigun loopies will whine and cry, but in the end, this portends well for us.
The reality is that we're now at 40 states that have mandated "Shall Issue" policies, and another two (Vermont and Alaska) that don't NEED a policy at all, bringing the number of states that recognize our absolute human right to self defense to a total of 42 states. The rate by which the states have been changing has accelerated in recent times as the legislatures in those states realize the wisdom that "more guns equal less crime". In every one of the states that have changed their policies, violent crime has been reduced, property crime has also been reduced, and the burden removed from law enforcement has meant those states have reaped a literal "peace benefit" because the police are now able to have civilian support to foil crime, and they can go do what they're supposed to... catch the bad guys. The holdouts are the 'usual suspects', those liberal bastions that, despite 40+ years (or more) of gun control without any tangible or measurable societal benefit, keep trying to heap more bad legislation on top of bad policy, compounding the error. It's more or less like trying to put a bow on a turd thinking it'll smell better. A huge thumbs up to GOA and NRA for this win. Here's hopin' New Jersey won't be too far behind... ![]()

Glad to hear this! I keep waiting for the ban on all my pre-ban pieces that I have collected since 85. At least I have had some fun turning AR-15s into a hangun that I have a permit to carry

Ok, folks...as a San Franciscan and a "liberal democrat"...that's communist for some of you...both the wife and I voted against this stupid bill...not everyone likes this stupid idiotic bill. I don't own a gun now but did when I was young, did my own "loads" and went shooting in the ranges practically every week. I certainly want the right to own a piece if I wanted to. This bill made us very angry and it certainly doesn't reflect all of us here. There are politicians who play up to certainly ways of thinking on both the right and the left.
I don't always agree with the NRA, but am very happy they went after this one. At this point, I can't even buy a gun in SF, but would have to travel out of the county to buy one. In fact, I'm sitting here looking at American Rifleman and thinking that a nice Glock or Kimber would be cool. But then Ruger is making the Blackhawk again which I owned in the 1960s....I'm still a liberal democrat!! and don't always agree with my party.... |

SF got off easy... a judge kept them from having my NRA get real nasty... and nasty they were going to get! The NRA just laughed when they tried this joke...
This is just like the gay marraiges... "lets do something real edgy that irritates everyone for some kicks!" Now where is that "big one" earthquake? (Davis... please make sure you and yours are out of town that day) Oh wait... "Liberal democrat???" Can you swim pretty well? ![]() |
