Sorry for this rant, but I have to get it off my chest.

My son is supposed to start school this month. He has special needs as he has CCHS (Ondine's Curse). He has a trach and needs to be ventilated when he sleeps but only when he sleeps. He isn't developementally challenged. He just requires a RN with him at all time while at school for suctioning, and his ventilator.

We have tried numerous time to get the school system to call us back, three time this week alone. No Luck ,seems like they are dodging us. I think they don't wanna pay for the nursing.

We have also contacted DSS about this as they are supposed to help. Guess what, they haven't returned our calls either.

Thing is we have been trying to get this done all summer.

I have reached the end of my rope, to the point I am ready to go up there and beat the hell outta someone. Stress doesn't even touch how i feel about this. Any suggestions on this would be appreciated. Only thing i know to do now is call my cousin,who is an attorney.

this is the area of law I practice in. Have you checked with the Civil Rights unit of the dept. of education? They would be in the best postion to advise you as to what the school district is required to do for you.

Thanks for the advice Vic. I will look into this. They have til tomarrow to contact me ,then I am going to give my cousin a call, he is an attorney for the Law firm Senator Sam Ervinand the Byrd Brothers started. They are probably the top law firm around here. Again Vic, I appreciate the advice.

Here is a link to provide you and your cousin with some basic information, including how to file a complaint under Title II of the Americans with Disabilities Act and Section 504 of the Rehabilitation Act. I don't know what area of the law your cousin practices in, so it may prove helpful to him, if not at the least it is good reading material for your and your wife. Thanks again, Vic. Way above and beyond. He is in criminal law mostly, but told me earlier in the year if I had any trouble with the schools to let him know. They take other cases,specially if they know you.

What state are You in? In Calif I believe they HAVE to provide you with the services. I can't imagine it would not be the same where ever you live. Heck we had to pay for taxis to another campus because our school didn't have somethingg the kids needed. Hope it works out for you..

Same in Nebraska. My wife works in the local school system, and a child such as stated earlier would have a nurse provided at public expense. It could be that the school system is dodging you hoping that you will go away and put the child in a private school. I am sure that once the attorneys get involved, things will happen in your favor. I know that in Nebraska, the right of every child (regardless of disability) to recieve a public education is enshrined in the State Constitution. I don't know what Federal Law states.

Well wouldn't you know it. I make a call to my attorney this morning. He says he will call and see what the hold up is. That was about 9 am this morning. Around noon, we get a call from the man in charge of the program and soon after ,get a call from someone else in the school system. Their excuse was they have just been so busy, that they had planned on calling us back today.

I think they just wanted us to homeschool or private school him, and were just trying to see if we were going to push the issue. I would have loved to have been a fly on the wall when my Attorney called them this morning. He peobably faxed them a nice letter too.

Now, I am not sure what my attorney said , but you wouldn't believe how nice and friendly and willing to help they have become. Now they School system and the DSS are arguing over who is going to supply the nursing. Chit gets done when an attorney puts his head in the battle.

Thanks to everyone who offered syggestions, I appreciate it alot.
