Lightbulb Anyone happen to be a lawyer?

It's nothing terrible. i didn't do anything, yet . I might burn down a certain car dealership....

Basically, for the past few months i've been getting screwed by a car dealership.. used car. 2000 VW Jetta. The car was guaranteed to pass MA state inspection. It failed, I brought it back, they claimed to "fix it". A day after I got it back, the check engine light comes back on. Take it to my mechanic, he says i need a new catalytic converter and O2 sensors. His estimate - 1300. (Turns out the dealership put a used catalytic in my car the first time hoping it would pass MA inspection. Which is a no-no in MA). Anyway, I bring it back, they say they will fix it cheaper. They put in an after market part, that my new mechanic (Master mechanic for VW for over 20yrs) has never even seen and doesn't even understand hte design of it.

I'm taking it up to the dealership this saturday to talk to the owner. I just wanted to ask what legal rights do I have to getting my car fixed... My options that I plan on giving him are:

1. He gives me a basically "blank" check to fix the car no matter what it costs. I'm not giving it to him to fix, he has had his chances and screwed up both of them.

OR

2. He writes me a check for 8k and I pay off my loan and move on and purchase another car somewhere else.

OR

3. He refuses to do either, I bring him to court and file that I want number 1 accomplished. Or number 2 PLUS lawyer fees and punitive damages.

Any advice?

You forgot option 4.

Richard and I load up in the Bing mobile and go pay him a visit. I think this is the most likely way to ensure you get a brand new car and free service for ever.

Does someone need a favor ?

I know in Mass the lemon law states that they only have three times to fix it. Also if the car does not pass Mass Inspection, they have to give your money back by law.

Don't feel too bad about that Craig, I quickly looked up the MA Lemon Law, you only would have had 14 days to void the sale under it. If at this point a few months have passed, it would be too late to void the sale, although you may have had other protections.

Vic,

if a dealer here sells you a car that does not pass inspection under law they have to fix or replace. They are super strict here on this. Does the lemon law not extend further to cover passing inspection.

Simply curious.

Honestly not to be mean but you look pretty young, you might be well suited to ask someone like Richard or myself to see if there was not a spare moment to talk with the guy. Either one of us could make sure he was understanding of your not just a punk a$$ kid who he can screw.

Put big sign on car saying so and so dealer so you a lemon - refuses to fix it.

Hook said car up to a tow truck or rent a dolly and drive back in forth in front of dealer until he either fixes or replaces it.

I like this option also we could take our Yukon and rent a dolly load up your VW and get some signs made and herf and drive around in front of the dealership.
